1. Purpose

These terms govern the use of the Somilou app. By creating an account, you accept them. If you do not accept them, do not use the app.

2. Who publishes Somilou

Somilou is published by Nicolaï Kasepov, as a private individual.

Contact: contact@somilou.com.

3. The service

Somilou helps parents track their baby’s sleep and meals. The app records naps, nights and bottles, offers nap and bedtime predictions, shows statistics, and lets you share a baby’s tracking with other people.

Somilou is free.

4. Somilou is not medical advice

Somilou’s predictions and statistics are indicative. They are calculated from general age-based guidelines and from what you have recorded. They may be inaccurate and do not take your child’s health into account.

  • Somilou provides no medical advice and does not replace a doctor, a paediatrician or a midwife.
  • Somilou is not a medical device or a monitoring tool: the app does not monitor your baby and does not alert you if something is wrong.
  • Do not change safe-sleep recommendations or a treatment based on Somilou.
  • For any question about your child’s health or sleep, consult a healthcare professional. In an emergency, call your country’s emergency services immediately (15 in France, 112 in the European Union).

You alone decide what is right for your child.

5. Who can use Somilou

Somilou is intended for adults (18 or over) who look after a child: parents, guardians or people who have custody. You may only record a child’s data if you are entitled to do so.

6. Your account

You sign in with your Google or Apple account. You are responsible for access to that account and to your phone: any action taken from your account is deemed to have been taken by you.

You agree to enter accurate information. Predictions depend directly on what you record.

7. Sharing a baby

You can invite other people to follow a baby with you:

  • each invited person sees the baby’s whole history and can edit it;
  • the baby’s owner can remove a member at any time, and anyone can leave a share;
  • if the owner deletes their account, the baby and its history are transferred to a person it was shared with.

Only invite people you trust: you are responsible for the access you give.

8. What is not allowed

By using Somilou, you agree not to:

  • use it for illegal purposes, or to record a child’s data without being entitled to;
  • try to access other users’ data or bypass the app’s protections;
  • disrupt the service, introduce malicious software into it or overload it;
  • extract data from the app by automated means, or use it to train an artificial intelligence model;
  • copy, modify, decompile or resell the app, except where the law allows it.

9. Intellectual property

The app, its code, name, logo, algorithms and content belong to the publisher. You receive a personal, free, non-exclusive and non-transferable right of use, for your private use, as long as you comply with these terms.

10. Your data

You remain in control of the data you enter. You authorise us to host and process it to provide the service.

As set out in the privacy policy, we also produce anonymised statistics from the data of all users, which identify neither you nor your child. We may use them and share them with third parties, including for payment.

The processing of your personal data is described in the privacy policy, which forms part of these terms. You can export your data or delete your account at any time from Settings.

11. Availability and changes to the service

We do our best to make Somilou work properly, but cannot guarantee a service free of interruptions or errors. The app works partly offline; your entries are synchronised as soon as the connection returns.

We may change the app, add or remove features, and update it automatically. If we decide to discontinue Somilou, we will let you know in advance so you have time to export your data.

12. Liability

Somilou is provided free of charge, as is. To the extent permitted by law, the publisher is not liable for:

  • decisions made on the basis of the app’s predictions or statistics (see section 4);
  • damage caused by use that does not comply with these terms;
  • interruptions or data loss caused by your device, your connection or a third-party service (Google, Apple, hosting provider, app store).

Nothing in these terms limits the publisher’s liability where the law forbids it, in particular in the event of gross or intentional misconduct, or personal injury.

13. Suspension and termination

You can stop using Somilou at any time and delete your account from Settings.

If you do not comply with these terms, we may suspend or delete your account. Except in an emergency (security, infringement of others’ rights), we will warn you beforehand and give you the opportunity to explain.

14. App Store and Google Play

These terms bind you to the publisher of Somilou, not to Apple or Google, who are not responsible for the app or its support. The terms of the store from which you downloaded Somilou also apply. If you use an Apple device, Apple and its subsidiaries may rely on these terms against you.

15. Changes to the terms

We may change these terms, for example to reflect changes to the app or the law. The version date appears at the top of the page. In the event of a significant change, we will inform you in the app before it takes effect. If you do not agree, you can delete your account.

16. Miscellaneous

If any clause of these terms is held invalid, the others remain in force. Failure to enforce a right does not constitute a waiver of that right.

17. Governing law and disputes

These terms are governed by French law. If there is a problem, please write to us first: we will look for an amicable solution. Failing that, the dispute will be brought before the competent courts under the applicable rules. If you are a consumer, you may in particular bring proceedings before the court of your place of residence.
